Elevating 8 Empowered Movement Programs Notice of Policies and Waiver of Liability

 

Fees: Participants of Elevating 8 Empowered Movement Programs are responsible to pay the fee of their respective package ahead of receiving services. Participants who do not pay ahead of services provided will not receive service. Servies, Packages and recurring Monthly Subscriptions are non-refundable.

Extenuating circumstances that do not include pre-existing conditions, with evidence, will be considered.

It is the responsibility of the participant to cancel all sessions at least 24 hours ahead of scheduled time by directly contacting Codi Herr via 818-746-6945.

It is the responsibility of the participant enrolled in a recurring monthly subscription to notify Codi of plans to cancel at least 5 business days ahead of recurring charge date. Participants must cancel their subscription at least 24 hours ahead of the recurring charge date to avoid the recurring fee.

 

Information Sheet and Disclosure of Health Concerns: Each participant, before receiving their program or services, shall sign a Liability Waiver, complete a Medical Information Sheet and participate in a consultation with Codi Herr. By the time of consultation, each participant must disclose all health related concerns and provide Codi with a release for activity from their physician related to any current health concerns, for which they are currently receiving care, that are presented. It is the responsibility of the participant to inform Codi of all medical and health concerns.

 

Termination of Client/Trainer Relationship: Codi/Elevating 8 may terminate the relationship with the client, when the client has engaged in willful, intentional, reckless or unintentional acts that put the client or others at risk and present as a liability to Codi, others or the facility where services occur.

 

Possession of Intellectual Property: Individualized Programs and training guides are intellectual property of Codi Herr and Elevating 8 Empowered Movement Programs, LLC. Individualized programs and training guides are specifically intended for the named recipient, and it is illegal to reproduce, sell or otherwise distribute the program that you receive from Codi and Elevating 8.

 

Proper Use of the Equipment and Program Completion: It is required that participants listen to trainers and remain within their limitations. Participants should wait for direction, listen to details and use smooth movements with proper form. Codi will provide you with specific directions in order to complete your program or exercise, which may include details on tempo, repetitions and weights. Please note that it is your responsibility to maintain your own limitations and work within your personal scope of experience and abilities, while considering Codi’s recommendations.

 

Waiver of Liability: With my participation in Elevating 8 programs, I hereby waive, release, and discharge any and all claims for death, personal injury or property damage which I may have, or which may hereafter accrue to me, as a result of my participation in the activities of the Center.

 

This release is intended to discharge in advance Codi Herr, Elevating 8 Empowered Movement Programs, LLC, facilities where services occur, their agents, employees, representatives, and assigns, and any individuals involved from and against any and all liability arising out of or connected in any way with my participation in the Elevating 8 services. I further understand that serious accidents occasionally occur with the use of exercise equipment and the act of movement, and that participants occasionally sustain mortal or serious personal injuries and/or property damage as a consequence of participating. Nevertheless, knowing the risk of participation, I hereby agree to assume those risks and to otherwise be liable to me (or my heirs or assigns) for damages. It is further understood and agreed that this waiver, release, and assumption of risk is binding upon my heirs and assigns.

 

Should any party bound by these rules bring suit against Elevating 8, Codi Herr or facilities where services occur on any claim or matter and fail to obtain judgment therein, said party shall be liable to the entities listed for all costs and expenses incurred in the defense of such suit (including reasonable attorneys’ fees).

 

I warrant that I am in good physical health and condition and that I am physically able to participate in the activities involved with Elevating 8 service that I signed up for. I have disclosed all physical restrictions. I have been advised by Codi Herr that it would be in my best interest to consult a physician prior to actively participating in services. I recognize and understand that strenuous physical activity can activate an unrecognized pre-existing cardiovascular or other medical condition, which I may have, thereby resulting in serious or life-threatening physical harm to me.
